I have also suggested another:- viz: that

as regards the ships not covered by the HongKong

Ordinance, the Regulations appended to the Imperial

Act are still in force. This was actually the case

until the Ordinance of 1889 was passed see Section

of Ordinance V of 1874. When the Ordinance of 1889

came home, it was treated as a mere consolidation

Ordinance and the omission of this Section in the

but its mission can hard by have the effect of the Act 11855

I should like to call your attention also tong Section 6 of the HongKong Ordinance which deals with

all Chinese passenger ships and prescribes the condi-

tions under which such ships are to obtain the

Certificate prescribed by Section 4 of the Imperial

Act.

Might it not alternatively be argued that

the effect of this Section is this viz:- the HongKong

Legislature has decided to "regulate" Chinese Passenger

Ships, not being ships carrying Chinese, by preventing

non-Chinese Asiatics from being carried in such ships at all.?

In other words, the Hong Kong Legislature

has made two separate sets of regulations for Chinese

passenger ships, which taken together are a complete

exercise of its powers:-

(1)

Ships may carry Chinese Asiatics on certain

conditions.

(ii) Ships may not carry non-Chinese Asiatics

at all.
